Rules for buying goods in the online shop creativpackaging.com

1. General provisions
1.1 These Terms and Conditions of Purchase of Goods (hereinafter referred to as the "Terms and Conditions"), once they have been approved by the Buyer (by familiarising himself with the Terms and Conditions and by ticking the box next to the statement "I have read and accept the Terms and Conditions of creativpackaging.com"), shall constitute a binding legal document, which shall determine the Buyer's and the Seller's rights and duties, the conditions of purchase of the Goods and the conditions for their payment, the procedure of delivery and return of the Goods, the parties' liability and any other provisions relating to the purchase of the Goods in the online shop of creativpackaging.com.
1.2 The Seller reserves the right to change, amend or supplement the Terms and Conditions. The Buyer will be obliged to re-confirm the Terms and Conditions each time he/she accesses the website.
1.3 All able-bodied natural persons and legal entities are entitled to make purchases in the Shop.
2. Protection of personal data
2.1. creativpackaging.com has the right to collect personal data provided by the Customer to creativpackaging.com and to disclose it to third parties if this is necessary for the execution of the order. The Buyer's data may only be used for information purposes with the Buyer's consent (by reading the Terms and Conditions and by ticking the box next to the statement "I have read and agree to the Terms and Conditions"). The Buyer has the right to prohibit the collection and processing of his/her personal data at any time, except where this is necessary for the fulfilment of the requirements arising from the sales contract or for the execution of the order. The Seller undertakes to protect from third parties the data concerning the Buyer of the online shop creativpackaging.com.
3. Entry into force of the sale and purchase agreement
3.1 The Contract between the Buyer and the Seller shall be deemed to have been concluded from the moment the Buyer has formed a shopping cart and paid for the goods.
4. Buyer's rights
4.1 The Buyer shall have the right to purchase goods in the creativpackaging.com online shop in accordance with these Terms and Conditions.
4.2 The Buyer shall have the right to withdraw from the contract of sale and purchase of goods concluded with the panve.lt online shop by notifying the Seller in writing (by e-mail), specifying the product to be returned, no later than within 7 (seven) working days from the date of delivery of the item (this requirement does not apply to products that do not meet the quality requirements).
4.3 The Buyer may only exercise the right provided that the goods have not been damaged or substantially altered in appearance or used.
5. Obligations of the Buyer
5.1 The Buyer is obliged to accept the Goods in accordance with these Conditions and to pay the agreed amount for them.
5.2 If the data provided by the Buyer on the registration form changes, the Buyer must update it immediately.
5.3 The Buyer, using the creativpackaging.com online shop, undertakes to comply with these Terms and Conditions and not to violate the legislation of the Republic of Lithuania.
5.4 If the Buyer refuses to accept the goods at the time of delivery without important reasons, the Buyer shall be obliged to pay the delivery costs.
6. Seller's rights
6.1 In serious circumstances, the Seller may temporarily or permanently suspend the operation of the Online Shop without prior notice to the Buyer.
6.2 The Seller shall be entitled to cancel the Buyer's order without prior notice to the Buyer if the Buyer fails to pay for the Goods within 5 (five) working days after having chosen the payment methods provided for non-cash payment.
6.3. creativpackaging.com shall have the right to cancel the concluded contract of sale if the stock of the goods specified in the contract is exhausted.
7. Obligations of the Seller
7.1 The Seller undertakes to enable the Buyer to use the services provided by the online shop creativpackaging.com under the terms and conditions set out in these Terms and Conditions and in the Online Shop.
7.2 The Seller undertakes to deliver the goods ordered by the Buyer to the address and under the conditions set out in these Conditions.
7.3 If the Seller, due to important circumstances, is unable to deliver the goods ordered to the Buyer, the Seller undertakes to refund the money paid by the Buyer within 3 (three) working days, if the prepayment was made.
7.4 The Seller undertakes to respect the Buyer's right to privacy with regard to his personal information provided in the online shop registration form, except in the cases provided for by the laws of the Republic of Lithuania.
8. Prices and payment arrangements
8.1 The prices of the goods in the online shop and in the order form are quoted in euros including VAT. creativpackaging.com reserves the right to change the prices of the goods.
8.2 Payment by bank transfer is a prepayment where the Buyer, after printing the order and going to the nearest bank branch or simply using the online banking system, transfers money to one of the creativpackaging.com bank accounts.
9. Delivery of goods
9.1 The Seller undertakes to deliver the Goods to the Buyer in accordance with the terms specified in the descriptions of the Goods. The Buyer agrees that in exceptional circumstances the delivery of the goods may be delayed due to force majeure.
9.2 The Buyer undertakes to specify the exact place of delivery when ordering the Goods.
9.3 The Buyer undertakes to accept the goods himself. In the event that the Buyer is unable to take delivery of the Goods himself and the Goods have been delivered to the address indicated and on the basis of other data provided by the Buyer, the Buyer shall not be entitled to claim against the Seller for delivery of the Goods to the wrong entity.
9.4 The delivery charge and more detailed information relating to the delivery of the Goods are set out in the "Delivery" section of the Online Shop.
9.5 In the event that the Buyer withdraws from the contract of sale in accordance with these Terms and Conditions, the Buyer shall be liable for all direct costs of returning the goods to the Seller. The amount of such costs incurred by the Seller shall be deducted from the monies paid by the Buyer for the Goods to be returned.
9.6 If it is not possible to deliver the ordered goods in one consignment, creativpackaging.com shall be entitled to deliver the goods in several consignments.
9.7 In all cases, the Seller shall be exempt from liability for breach of delivery deadlines if the goods are not delivered to the Buyer or are not delivered on time due to the Buyer's fault or due to circumstances beyond the Buyer's control.
10. Quality and fitness for use of the goods
10.1 In the event of return of faulty goods, the Seller shall bear the cost of return.
10.2 All Goods sold on creativpackaging.com are new (unless the purchase box indicates that the Goods are defective, have lost their merchantable appearance, etc.), and are stored in good quality storage facilities. However, goods shall not be considered to be of poor quality if minor packaging or transport damage can be observed on the goods.

11. Returns and exchanges

11.1 Please notify the Seller immediately of the return of the Goods by email to info@panve.lt, indicating the VAT invoice number of your purchase of the Goods in the "Subject" line of the email and the words "Goods to be returned". In the letter, please state the name of the goods and a brief description of the reason for the return. Quality goods must be returned in exactly the same condition as you received them - in their original packaging, undamaged, unused and in good condition.
11.2 In the case of returns of poor quality goods (e.g. shredded patches of leather, etc.), the Seller shall pay the shipping costs.
11.3 In the case of returns of quality goods, the Buyer shall pay the shipping costs. Upon receipt of the returned goods, the Seller will inform the Buyer by a separate email and, in accordance with European Union e-commerce laws, will refund the Buyer's money to the specified account or replace the goods.
11.4 In the event that the Buyer's consignment has been subject to a transport charge, the delivery costs will not be refunded.
11.5 The returned goods must be in their original packaging, in good condition, undamaged by the Buyer, in the same condition as received by the Buyer (labels intact, protective film not torn off, etc. (this clause does not apply to the return of low-quality goods), and in the same condition as received by the Buyer, and must be accompanied by a confirmation of the purchase of the goods.
11.6 The Seller shall have the right not to accept the Buyer's return of the Goods if the Buyer does not comply with the return procedure set out in this Article.


12. Liability
12.1 The Buyer is fully responsible for the accuracy of the data provided in the registration form. If the Buyer fails to provide accurate information on the registration form, the Seller shall not be liable for any consequences arising therefrom.
12.2 The Buyer shall be responsible for the actions carried out using this online shop.
12.3 The Seller shall be exempt from any liability in cases where the loss is caused by the Buyer's failure to read these Terms and Conditions, despite having been given the opportunity to do so, without regard to the Seller's recommendations and its obligations.


13. Exchange of information
13.1 The Seller shall send all communications to the email address provided by the Buyer in the registration form.
13.2.The Buyer shall send all notifications and questions to the contact means indicated in the "Contacts" section of the Seller's online shop.


14. Final provisions
14.1 All disagreements arising from the execution of these Terms and Conditions shall be settled by negotiation. In the event of failure to reach an agreement, disputes shall be settled in accordance with the procedure established by the laws of the Republic of Lithuania.
